Abstract

This article aims to show, within the framework of the works on Romanistic tradition, the influence of Roman doctrine and legislation in the construction of the Spanish legal system throughout its different historical stages. In this case, in particular, a review of the doctrinal and legislative antecedents of article 612 of the Spanish Civil Code is made, highlighting those legal elements that are part of it and that have their origin in Roman law, taking the Roman jurist Gaius as starting point.
