Abstract

Despite the roman-visigothic legal tradition, that favored the owner's freedom of disposal, in the Early Middle Ages the first preferential acquisition rights were forged in the Hispanic Kingdoms. The process was slow and different in each territory. It was the first important step for its regulation in the Late Middle Ages and its general acceptance in Modernity.
