The ‘ius commune europaeum’ of yesterday and today

Europe is a cultural phenomenon that was born with Charlemagne, in which the "ius commune europaeum" and the "iura propia" are configured and contrasted. The legal unity achieved, in which university-trained jurists played a special role, was broken with the Enlightenment and the Codification. But at the same time as the old "ius commune" was extinguished, a new common European law appeared, a law of the citizen, the primary source and ultimate addressee of all power.
