Abstract

The term iurgare is the subject of an etymological, legal and textual analysis, as the first technical term through which the meaning of litigation was evoked in Ancient Rome. In addition to bringing up the different doctrinal positions regarding their meaning, we will argue that not only does the lexical and etymological examination of technical-legal terms help to understand and penetrate the Roman legal mentality, but that they are also relevant from the point of view of the structure of Roman Procedural Law.
