Abstract

The Code pénal of Napoleon of 1810 has been considered the first liberal penal Code enacted in Europe, and the first Spanish penal code was enacted in 1822. Historiography maintains that the Code pénal was the most influential penal Code in Europe and had a great influence on the Spanish penal Code. This article examines the real influence of the French Code on the first Spanish penal Code through a historiographical approach to this matter, exploring scholarly works from the 20th century to the present.
