Abstract

The historical-legal study of the contribution of jurisprudence in the evolution of the special part of Spanish criminal law is receiving particular attention in recent times. In order to delve deeper into this field, the main objective of this research, namely, the examination of the crime of fraud according to the judicial rulings of the Supreme Court from 1870 to 1970. This article shows the role of jurisprudence in the application and interpretation of this criminal figure. The results indicate that, except for two specific basic elements, it exerted a significant influence on the configuration of its legal nature.
